Welcome to MaxArt.ai! Our website, located at https://maxart.ai (Website), provides AI image and video generation services (the Service). By accessing or using our Website, you agree to be bound by these Terms of Service (Terms). If you do not agree with any part of the Terms, then you are prohibited from using the Website.

1. Accounts and Credits

To use the Service you sign in with a supported identity provider (for example, Google). New accounts receive free starter credits so you can try the Service before paying. Credits are the consumption unit of the Service: each generation deducts credits from your balance at the rate shown on the tool page before you confirm.

Credits never expire. Credits have no cash value, are not transferable, and can only be used on the Website. You are responsible for keeping your account credentials secure and for all activity under your account.

2. Subscriptions and Billing

Paid plans are offered as monthly or yearly subscriptions, and as one-time credit packs. Payments are processed by Stripe; by purchasing you also agree to Stripe's terms presented at checkout.

• Subscriptions renew automatically at the end of each billing period at the price shown on the plan card. If you purchased with a first-year promotional price, the renewal is charged at the regular yearly price shown at checkout (for example: $79 for the first year, then $120/year).
• On yearly plans, credits are granted monthly — a fixed amount each month, 12 times over the year — not all at once.
• Upgrades to a higher plan take effect immediately; the price difference for the remaining period is calculated and charged at the time you confirm the upgrade. Downgrades are handled by cancelling renewal and subscribing to the lower plan after the paid period ends.
• One-time credit packs are charged once, do not renew, and the credits never expire.

3. Cancellation

You can cancel subscription renewal at any time, in seconds, with no cancellation fee: open Manage Subscription from your account or from the link in your billing emails (Stripe customer portal), or email us at support@maxart.ai and we will cancel it for you.

Cancellation stops future renewals only. Your plan stays fully active until the end of the current paid period, and no further charges are made after that. On a cancelled yearly plan, monthly credit grants continue until the last month of your paid year, then stop. Every credit already granted stays in your balance forever.

4. Refunds

Prepaid subscription time is not refundable: when you cancel, you keep full access until the end of the paid period instead of receiving money back. One-time credit packs can be refunded within 14 days of purchase only if none of the pack's credits have been used. Billing errors and credits that were charged but not delivered are always corrected or refunded. Full conditions are described in our Refund & Cancellation Policy. Nothing in these Terms limits any right you have under mandatory consumer protection law.

5. Your Content and Commercial Use

You retain all rights to the images and videos you generate with the Service, to the extent permitted by applicable law. MaxArt.ai claims no ownership over content created by users.

Content generated under a paid subscription or with purchased credits may be used for commercial purposes, including client work, advertising, and monetized content. Content generated on the free tier is watermarked and licensed for personal, evaluation use only; upgrade to a paid plan for commercial use and unwatermarked downloads.

You must own or have permission to use any photo, video, or other material you upload. AI-generated output may not be eligible for copyright protection in some jurisdictions, and similar output may be generated for other users; MaxArt.ai does not guarantee exclusivity of any output.

6. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that is unlawful, infringing, defamatory, deceptive, sexually explicit involving minors, non-consensual intimate imagery, or otherwise violates our content policies; not to misrepresent AI-generated content as authentic records of real events; and not to abuse the Service (including scraping, reselling access, or circumventing rate limits or watermarks). We may suspend or terminate accounts that violate these rules, without refund for unused paid time where the violation is material.

7. Service Availability and Changes

The Service is provided on an "as is" and "as available" basis. We may add, change, or discontinue features or AI models, and may change prices or these Terms with notice by email or on the Website. Price changes apply from your next renewal and never retroactively to a period you have already paid for. Your continued use of the Website after any change will constitute your acceptance of such changes.

8. Privacy

We collect personal data (name, email, and payment information processed by Stripe) and non-personal data (web cookies) to provide and improve the Service. The use of this data is governed by our Privacy Policy, which can be found at 개인정보 보호 정책.

9. Governing Law

본 약관은 미국 법률에 따라 해석 및 적용됩니다.
